Terms of Service
The Main Stuff
- By sending an order form, you agree to everything in this TOS as of the sent date. Sorry for the long read but I just want to make sure all of my bases are covered! These are also here so you know how I work in case some things don’t line up for you and you can decide whether to continue with sending the request form.
- I have the right to reject any commission request I don't see fit in doing, even after I started the project.
- All payments are done through PAYPAL INVOICES ONLY unless discussed otherwise beforehand.
- You have the option to pay half upfront and the remaining half when the sketch is completed, but everything upfront is fine as well.
- If you try requesting for a different form of payment (ex. Bank transfers), I will cancel the order.
- I will not offer payment plans unless for larger projects. If you’d like to discuss this, please don’t hesitate to ask.
- There is an option to tip in the invoice sent. You’re not required to tip, but any amount is appreciated
- All listed prices are in USD
- All artworks commissioned from me are intended for PERSONAL USE ONLY unless COMMERCIAL RIGHTS ARE DISCUSSED AND PAID FOR ACCORDINGLY.
- Personal usage means that you use the artwork for yourself—You are able to do pretty much anything with it like setting it as a profile picture, saving to an online gallery for a character, reposting on your own social media, etc. as long as you are not gaining financially with the said artwork.
- NO AI TRAINING WITH MY ART IS ALLOWED. If I find out you use mine or anyone else’s artwork for GenAI training/putting it in a database/using GenAI to alter the image, your use rights for the artwork will be voided.
- Using my artwork for crypto or blockchains will also be given the same regard as above.
- If you are caught using my artwork for GenAI while an order is in progress, I will cancel the order and not refund anything that’s been given to me already through invoice.
- If you are interested in having the artwork used commercially (ie. to sell a product, reprinted as merchandise, other ways that you gain money with my art), we can discuss the scope of what you want for your project as well as the added costs to the total invoice. - I am allowed to blacklist anyone from making requests for my services for any reason (including things not mentioned in the TOS)
- If your order has a specific deadline needed PLEASE LET ME KNOW BEFORE I BEGIN—That way I can know if the due date is possible with my current workload and adjust things if needed.
Refund Policy
- If, for any reason, the commission could not be completed, I will refund the amount equivalent to how much is left to be finished in the artwork. After the sketch is completed and approved, the refund amount will start at half the total paid already for the commission (50%), then goes down from there as I continue to work on it.
- For example, if the sketch is approved, values are cleaned up in the painting, and I’m just about to put down colors before the commission is cancelled, I may give around 25% of the paid amount as a refund to cover costs of labor already put in.
- I’m taking into account how much time has been put into the order and how much I was expecting to put in if it was seen to completion.
- Any additional money sent during the duration of the commission process to pay for the work, such as tips and edit costs, will be added to the total amount referenced for determining refunds.
- Again, if you are caught using my art for AI training or using GenAI to alter the artwork while a orderis in progress, I will terminate any further work and you WILL NOT RECEIVE A REFUND.
Edits
- After a commission is started, you may change your mind on things in the artwork at some point and that’s okay! However, some requests may not be so simple, and that's why this section is here
- If you change your mind on a certain aspect of a piece while, let’s say, I’m about to finish up with painting and about to put in the final details, I’d take into account how much time and effort it would take to adjust the piece before deciding whether to charge extra.
- I will always discuss pricing and details before going through with an edit if needed. Some edits may be small enough that it would be a quick fix that wouldn’t be charged at all. Otherwise, I’ll provide a quick mock-up, send an invoice, then proceed with the finished edit.
- This is mainly reserved for larger/more finished projects like scenes. Usually colored sketches and icons will be okay unless it comes to the point the entire commission has to be restarted.
Communication
- My main forms of communication are through Discord or email.
- I make a point to get back to any messages sent about a commission as soon as I can, however I can’t be available all the time. With a part-time job, college, and other life things happening all at once, I’d prefer to have my attention fully on the inquiry before giving a proper response. That being said, please be understanding if I take a bit to respond, your patience is greatly appreciated.
- Especially for the case on Discord, if you see me talking on other servers or doing something else other than your commission or if I haven’t gotten back to your question, please don’t rush for a response. I am entitled to having the time to do other things for myself outside of working. If there's a repeated case of you asking for more progress being done or for a faster response time, I may end up cancelling the order and blacklist future requests from you.
- During the process of an order, I’ll be sure to send updates of the artwork as I complete certain phases (sketches, values, colors, etc.). You’re also allowed to ask for a progress shot of what I have done outside of those milestones.
- I may stream progress of the commission on private servers or on Twitch potentially, and will usually ask for permission to do so before featuring the order in one of those. If you’re uncomfortable with this at any point, please let me know and I’ll be sure to note such and not share progress publicly any further.
- I also have a Trello board available so you can see where you are compared to other ongoing orders. Some may be completed before others depending on multiple factors like the size and quality, so please note that if you see an order made after you finish before yours.
Commercial useage + Copyright
- If you’re interested in using the artwork for monetary gain—such as advertising, products, reprinting, or other methods where you would benefit financially with my artwork—then you’re required to note that on the order form of your intention of use.
- If you initially ordered something from me for personal use, but decided later to start monetizing my artwork, then please reach out to me first so we can discuss potential added fees.
- Each case of commercial rights may be treated differently depending on the intended audience size, the intended use, etc.
- For the case of reprints of my artwork for merchandise, I may ask for royalties from sales.
- While discussing the scope of intended use commercially, an added fee will be applied to the invoice once an agreement is made. Again, the fee is not static and may vary depending on the client. Once we come to an agreement on everything related to your intended use, I may make a form for both of us to sign as proof of your acknowledgement to knowing what you are and are not allowed to do with the art.
- If I find that you break any of the rules listed on the form/go past what you’re allowed to use my art for, I may terminate any further use of my work with you.
- While you are buying the rights to use my art commercially, you do NOT have the copyrights to my art and cannot claim my art as your own creation. I am the creator of my work and would like to be credited as such where available. I may also use the work made for the project as part of my portfolio if I see it fit as something I’d like to demonstrate as part of my skillset.
